Welcome to BooksWriter, an AI-powered story creation platform owned and operated by BooksWriter ("BooksWriter", "we", "us" or "our"). These Terms of Service (which include our Code of Conduct and Privacy Policy) constitute a legally binding agreement between you ("User", "you" or "your") and BooksWriter. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms "User", "you" or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Services.

By using bookswriter.xyz (the "Site"), creating your BooksWriter account, and using the Site or our applications to create stories, publish content, or access and view content created by you or others (together with the Site, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You acknowledge that this Agreement is a contract between you and BooksWriter, even though it is electronic and is not physically signed by you, and it governs your use of the Services.

1. Age Requirement

You must be at least 13 years of age to use the BooksWriter Services. By using the Services and by agreeing to this Agreement, you warrant and represent that you are at least 13 years of age. If we discover that someone under 13 is using our Services, we will terminate their account immediately.

2. Account Registration

To access and use the full features of BooksWriter, you must register for an account using your Google account. We use Google authentication to provide secure access to our Services.

You are solely responsible for all activity that occurs on your account and for maintaining the security of your Google account credentials. If you share your account access with anyone, that person may be able to take control of your account, and we may not be able to determine the rightful account holder. We will not be liable to you or anyone with whom you share your account access for any actions taken under such circumstances. If you discover that someone has used your account without authorization, please report it immediately at support@bookswriter.xyz and secure your Google account.

One Account Per Person: You may only maintain one BooksWriter account. Creating or using multiple accounts is strictly prohibited. This includes, but is not limited to, creating multiple accounts to:

If we detect that you are operating multiple accounts, we reserve the right to suspend or terminate all associated accounts and remove any content posted from those accounts. We may also revoke any credits obtained through multiple accounts and take other appropriate action.

3. Your Content and Ownership

Before publishing content on BooksWriter, please review our Content Guidelines. Content that does not comply with these guidelines may be removed at any time.

Ownership: We do not claim ownership of any text, images, or other content that you create, store, or share through the Services ("Your Content"). All rights in and to Your Content remain with you. However, if content was not originally yours, publishing it on BooksWriter does not make it yours. Do not submit content for which you do not hold the copyright unless you have explicit permission to do so and to grant BooksWriter all the rights outlined in these Terms.

License to BooksWriter: When you upload or transmit Your Content through the Services, you grant us a non-exclusive, royalty-free, worldwide license to host, store, process, display, reproduce, modify, and transmit Your Content, but solely as necessary to provide and improve the Services. This limited license does not grant us the right to sell or distribute Your Content outside of these Services, except that we may use Your Content to promote the Services.

Sharing Your Content: If you choose to share or publish Your Content for others to view, you understand that third parties may be able to view, reproduce, modify, distribute, and display it. If you do not want others to have those rights, do not share Your Content in that manner.

Your Responsibility: By using the Services, you represent and warrant that you have all necessary rights to upload and share Your Content and that doing so does not infringe any laws or the rights of any third parties. You are fully responsible for the content you publish and for any consequences arising from creating, storing, or sharing Your Content, including claims of infringement or defamation. We are not liable for any third-party actions involving Your Content. We disclaim all liability related to Your Content that you or other users provide, store, or share through the Services.

You may enter into additional agreements with us that modify or supplement these Terms of Service, such as when participating in contests or special programs. In the event of any conflict between such additional agreements and these Terms of Service, the additional agreements will take precedence.

4. Intellectual Property Rights

Definition: "Intellectual Property Rights" means all present and future rights conferred by statute, common law or equity in or in relation to any copyright and related rights, trademarks, designs, patents, inventions, goodwill and the right to sue for passing off, rights to inventions, rights to use, and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, rights to claim priority from, such rights and all similar or equivalent rights or forms of protection and any other results of intellectual activity which subsist or will subsist now or in the future in any part of the world.

Our Rights: This Agreement does not transfer to you any intellectual property owned by BooksWriter or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with BooksWriter. We reserve all rights in the design, appearance, and content of the Site and Services. You may not copy, adapt, or use any portion of our code, visual design elements, or logos without our express written permission.

Trademarks: All trademarks, service marks, graphics and logos used in connection with the Services are trademarks or registered trademarks of BooksWriter or its licensors. Other trademarks, service marks, graphics and logos used in connection with the Services may be the trademarks of other third parties. Your use of the Services grants you no right or license to reproduce or otherwise use any BooksWriter or third-party trademarks. Please do not use our logo or trademarks in any manner that suggests BooksWriter endorses a particular product or service, or that you have a business relationship with BooksWriter. Do not alter, modify, distort, or otherwise change our logo in any way.

BooksWriter may modify, suspend, or discontinue any aspect of the Services at any time without notice. We reserve the right to remove any content you publish for any reason. BooksWriter may access, read, preserve, and disclose any information as we reasonably believe necessary to: (i) comply with applicable laws, regulations, legal processes, or governmental requests; (ii) enforce these Terms of Service, including investigating potential violations; (iii) detect, prevent, or address fraud, security, or technical issues; (iv) respond to user support requests; or (v) protect the rights, property, or safety of BooksWriter, our users, and the public.

BooksWriter respects intellectual property rights and has adopted a policy for addressing copyright infringement in accordance with applicable copyright laws. If you wish to submit a copyright infringement claim, please visit our page on Reporting Copyright Infringement.

We reserve the right to remove content alleged to be infringing without prior notice, at our sole discretion, and without liability. In appropriate circumstances, we will terminate accounts of users determined to be repeat infringers.

When we discover websites that have illegally copied content from BooksWriter, we take action to have them shut down. To act on your behalf in such situations, you authorize us to serve as your agent to issue takedown notices under applicable copyright laws to internet service providers and other parties involved in the unauthorized posting of your content.

Content generated by our AI systems is provided "as is" without warranties of any kind. While we strive for quality, we make no guarantees regarding the originality, accuracy, completeness, or suitability of AI-generated content for any particular purpose. You are responsible for reviewing, editing, and verifying all AI-generated content before using, publishing, or distributing it.

8. Credits System

BooksWriter operates on a credit-based system for accessing certain features. We do not currently accept payment for credits. Credits are distributed at our sole discretion for various reasons, including promotional purposes and user engagement.

Credit Allocation and Use:

Refund Policy: Due to the nature of digital services and the credit-based system, we do not provide refunds for credits that have been granted or used. If we implement paid subscriptions or credit purchases in the future, our refund policy will be clearly communicated at that time.

9. Account Deletion and Termination

You may permanently delete your BooksWriter account at any time. When you delete your account, it will first be deactivated. During deactivation, your account will not be viewable, but your comments and published content will remain in an anonymized form. For six months after deactivation, you may restore your account if it was deactivated accidentally or in error. After six months, we permanently delete your account from our systems, though anonymized comments and published content will remain on the Services.

We may suspend or terminate your account or cease providing you with all or part of the Services at any time for any reason we deem appropriate, including violations of these Terms of Service. We will make reasonable efforts to notify you via the email address associated with your account or when you next attempt to access your account.

10. Disclaimers and Limitations of Liability

No Warranty: Your use of the Services and any content is at your own risk. The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. BooksWriter disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Content Responsibility: All content is the sole responsibility of the person who created it. We do not monitor or control all content published via the Services and cannot take responsibility for such content. We do not endorse, support, or guarantee the accuracy, completeness, or reliability of any content. By using the Services, you may encounter content that is offensive, harmful, inaccurate, or misleading.

Release: You release BooksWriter from all claims, damages, and demands arising from: (a) disputes between users or between users and third parties relating to the Services, and (b) your use of the Services.

Limitation of Liability: BooksWriter will not be liable for any damages arising from your use of the Services, including but not limited to: (a) service interruptions or unavailability; (b) direct, indirect, punitive, incidental, consequential, special, or exemplary damages; (c) lost profits, data, or revenues; or (d) conduct or content of other users or third parties. In no event shall BooksWriter's total liability exceed one hundred U.S. dollars ($100.00).

Indemnification: You agree to indemnify and hold harmless BooksWriter from any liabilities, losses, claims, and expenses (including reasonable legal fees) arising from your use or misuse of the Services or your violation of these Terms of Service. We reserve the right to assume exclusive defense and control of any such matter, and you agree to cooperate with us in asserting any defenses.

Third-Party Websites: The Services may contain links to third-party websites. You access such websites at your own risk. We do not control or endorse third-party websites.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Changes to Terms

We may modify these Terms of Service from time to time. If we make material changes, we will notify you either through the Site or via email. Your continued use of the Services after any changes constitutes your acceptance of the new Terms of Service. If you do not agree to the revised terms, you must stop using the Services and close your account.

13. Dispute Resolution and Governing Law

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of the jurisdiction in which BooksWriter operates, without regard to its rules on conflicts or choice of law. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in that jurisdiction, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement.

14. General Provisions

Entire Agreement: These Terms of Service (including any documents incorporated by reference) constitute the entire agreement between you and BooksWriter regarding the Services and supersede all prior agreements.

Severability: All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment: These Terms are personal to you and may not be assigned, transferred, or sublicensed without our prior written consent. BooksWriter may assign, transfer, or delegate any of its rights and obligations under these Terms without notice or your consent.

15. Acceptance of These Terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Services.

Content Guidelines

At BooksWriter, we empower creativity with the goal of creating a safe and comfortable space for everyone to discover and create stories.

To create an inclusive and respectful environment, we want to ensure our users know what type of content they can discover and what content they can or cannot post.

Before you begin your writing journey, please review the following guidelines:

Rating Your Story

All creators are expected to rate their stories as either Mature or for Everyone, according to the guidelines provided below. If you come across a story that has been rated incorrectly, please report it at support@bookswriter.xyz. Please note that we will change your rating if it does not comply with these guidelines.

Mature Rating

Marking your story as Mature does not mean it can contain prohibited content. Stories that contain prohibited content will be removed regardless of their rating.

Mature stories are intended for an audience that is 17 and up. There are restrictions on discovering Mature stories on BooksWriter that help ensure they reach the correct audience. A story may be rated Mature if it contains any of the following:

If you feel that your story fits our guidelines but may include parts that aren't appropriate for younger readers, please rate your story as Mature.

What We Remove

The following content is not allowed on BooksWriter. This is not a complete list, and we have the right to remove any content that we find inappropriate. Any content that could put our community at risk will be removed. BooksWriter has the right to close any account or remove content without notice.

Sexual Content on BooksWriter

Pornographic Content: BooksWriter considers content to be pornographic when it exists solely for the purpose of sexual stimulation. Such content will be removed.

Age of Consent: The age of consent is 18+ on BooksWriter. Any sexual content between characters must abide by this age of consent and comply with applicable laws.

Glorification of Sexual Violence: BooksWriter classifies non-consensual sexual acts to include rape, sexual assault, kidnapping for sexual purposes, or sexual slavery. Content cannot encourage or promote non-consensual sex acts.

Sexual Roleplay or Messaging: BooksWriter does not permit sexual messages or solicitation. This includes publishing content which encourages sexual private messages, on or off BooksWriter, or publishing rules for public or private roleplay that are intended for sexual purposes.

Illegal Sex Acts: BooksWriter explicitly prohibits any content which describes illegal sex acts including, but not limited to, bestiality, necrophilia, incest, or child sexual exploitation and abuse material. Such content will be removed immediately.

Media on BooksWriter

Media on BooksWriter includes images. To help keep BooksWriter a safe space for everyone to create and discover content, we may remove media that doesn't follow our Content Guidelines. The following media is not allowed on BooksWriter and will be removed:

Self-Harm on BooksWriter

If you are struggling with eating disorders, addiction, self-harm, thoughts of suicide, or other challenges, we want you to know that you are supported. Please reach out to appropriate helplines and support services in your area.

There are many forms of violence that can be harmful to our community. We will remove any content or accounts that are intended to shock or disgust our community.

Hate Groups and Extremist Content

At BooksWriter, we are committed to keeping our community safe. We value diversity and storytelling, so we want to ensure that stories on BooksWriter do not contribute to real-world harm. The following guidelines have been developed to maintain a positive community.

On BooksWriter, you are not allowed to make physical threats of violence or threats of death towards any individual or group of people. We will not allow stories or individuals that glorify, praise, or romanticize current real-life violent hate groups, figures, or extremist organizations with violent or hateful intentions.
